We appreciate your time in reading these Terms of Service (“Terms”), which outline the agreement between you and Sofaree when you use our platform.

These Terms:

  • Establish the legal relationship between you and us;

  • Alongside your confirmation email (“Booking Confirmation”), describe the conditions under which accommodations and experiences (“Listings”) are made available through our platform;

  • Apply to all use of our platform, including your interactions and communications.

By accessing or using Sofaree’s website, app, or services, you agree to comply with these Terms. If you do not accept them, you may not use our platform or make bookings.

Booking any Listing (whether an accommodation or experience) indicates your full acceptance of these Terms.

We may update these Terms periodically. If you continue to use the platform after changes are made, you are accepting the new version. Existing bookings will remain subject to the Terms in effect at the time of confirmation.

Key Definitions

  • “we”, “us”, or “our” refers to Sofaree, the company operating this platform.

  • “Content” includes any information, media, or materials submitted to or made available through the platform.

  • “Service” means our websites, apps, support channels, and tools for exploring and booking Listings.

  • “Host” refers to individuals offering places to stay.

  • “Service Partner” includes businesses or professionals providing activities, rentals, or services.

  • “Listing Owner” is a general term that refers to any person or entity offering a listing—whether it’s a Host or Service Partner.

  • “Listing” refers to any accommodation or experience that can be booked through the platform.

  • “you” or “Guest” means the person using the platform or making a booking.


Section 1: Listing Rules and Conditions

In addition to these Terms, each Host or Service Partner may set their own policies that apply to a reservation (“Rules and Restrictions”). These can include house rules, refund terms, cancellation procedures, and other conditions. You’ll see these before finalizing a booking.

To proceed with a reservation, you must agree to the applicable Rules and Restrictions, which may address payment, refund eligibility, service access, or how the Listing may be used.

If you do not follow these conditions, the Host or Service Partner may cancel your booking and deny you access to the accommodation or activity. Refunds may not be available in such cases.

Rental terms between you and a Listing Owner are private agreements. Sofaree is not a participant in these contracts. These agreements:

  • Govern your right to access and use the accommodation or experience; and

  • May include liability limitations or behavioral expectations.

We strongly advise reviewing any agreement provided by the Listing Owner before confirming a reservation.

Sofaree is not obligated to mediate conflicts between Guests and Listing Owners. By using our platform, you agree that:

  • It is your responsibility to fulfill the terms agreed with the Listing Owner;

  • Sofaree does not enter into or manage contracts between Guests and Listing Owners;

  • Hosts and Service Partners operate independently from Sofaree;

  • Listing Owners are responsible for meeting local laws and licensing requirements in their respective locations.


Section 2: Using the Sofaree Platform

Verification and Identity

We may ask Listing Owners to confirm their identities and supply accurate information. While we apply reasonable screening measures, we do not guarantee the accuracy or completeness of their details.

We recommend that Guests and Listing Owners use Sofaree’s internal messaging tools for all communications. However, even these tools cannot fully guarantee a person’s identity. If anything seems suspicious, please contact us immediately.

Acceptable Use Guidelines

Sofaree is a digital platform that allows:

  • Guests to search for and book accommodations and experiences; and

  • Listing Owners to publish and manage their offerings.

Sofaree does not own, operate, or directly supply any of the accommodations or services listed.

By using our platform, you confirm that:

  • You are at least 18 years old and able to enter legal agreements;

  • Your use of the platform is for lawful, personal purposes only;

  • All details you provide are accurate and up to date;

  • If booking on behalf of others, you have their consent and will handle all related communications;

  • You will follow local laws and treat listings, neighbors, and communities with respect.

You also agree not to:

  • Submit false or speculative bookings;

  • Use bots, scrapers, or other tools to collect or monitor content;

  • Interfere with access restrictions or attempt to overload the system;

  • Embed, deep-link, or mirror Sofaree’s content without permission.

Account Requirements

To access full platform functionality, you may need to register for an account.

To create an account, you must be 18 years or older. You are responsible for protecting your login information and for all actions taken through your account, whether authorized by you or not.

Please notify us right away if you believe your account has been accessed without your permission.

Legal Obligations and Disclosure

Although Sofaree does not directly participate in contracts between Guests and Listing Owners, we may need to share certain data to comply with legal or regulatory requests.

You are responsible for making sure any legal or tax information you provide is accurate and current. In some jurisdictions, we may be required to collect, verify, or report tax-related details to the authorities.

Section 3: Booking Confirmation

Once you complete a reservation on Sofaree, a Booking Confirmation will be sent to the email address you provided. This document outlines the essential details of your reservation, including:

  • The type of Listing you reserved (e.g., accommodation or experience),

  • The name of the Host or Service Partner,

  • The agreed price and any additional charges.

Booking Confirmations are generated either by Sofaree or directly by the Listing Owner, depending on the setup of the listing. Regardless of the sender, the confirmation serves as evidence of your agreement.

If you do not receive your Booking Confirmation within 24 hours of making a reservation, please reach out to our support team as soon as possible.


Section 4: Payment

Pricing

The total cost of a Listing—whether for an accommodation or an experience—is shown on the Sofaree platform at the time of booking, unless otherwise indicated due to a technical or obvious error.

Prices are dynamic and may change over time. Any adjustments will not affect confirmed bookings, except where there is a clear pricing error.

Payment Processing

Sofaree uses third-party payment providers to securely process payments made for bookings. In some cases, the Host or Service Partner may rely on their own external payment processor. Regardless of who handles the transaction, you must follow the authorized payment options provided on the platform.

To prevent fraud and protect your information, you agree not to complete payments outside of Sofaree’s supported payment channels. Doing so violates these Terms and may expose you to financial risk.

Payment Verification

By submitting payment details, you authorize Sofaree or its payment partners to:

  • Confirm the validity of your payment method through pre-authorization, a temporary charge, or other standard verification tools, and

  • Charge your selected payment method upon successful verification.

Bank and Card Fees

Depending on your card issuer and the currency used, your bank may apply international transaction fees or currency conversion charges. For example, if you’re paying in a currency different from that of your card account, additional charges may apply.

Sofaree is not responsible for any fees or losses incurred due to exchange rates or financial institution policies. Contact your bank or card provider directly for details.

Currency Display and Payment Currency

While the platform may display prices in your local currency for convenience, the actual billing currency may differ and will always be shown clearly before you complete your booking. Currency rates are based on publicly available sources but may not reflect the exact rate used by your bank.

Any impact on the final amount charged or Sofaree’s service compensation may vary depending on the currency selected at checkout.

Service Fee

Sofaree may charge a service fee to Guests for each confirmed booking. This fee is typically calculated as a percentage of the total reservation value, including any additional costs or security deposits collected by the Listing Owner.

The service fee, along with any applicable transaction-related taxes, will be shown at checkout prior to completing your payment.

Taxes

Depending on local regulations in the country or region where the accommodation or experience is located, the total amount you pay may be subject to:

  • Value Added Tax (VAT), or other similar indirect taxes,

  • Tourist, lodging, or occupancy-related taxes imposed by local authorities.

When required, Sofaree will collect and remit these taxes on behalf of the Host or Service Partner. You’ll receive an invoice or confirmation indicating any taxes included in your total payment.

If you qualify for a tax exemption, you must provide the proper documentation before your booking is finalized so that it can be reviewed and applied accordingly.

In some cases, Guests may be responsible for submitting tax payments directly to authorities or requesting reimbursement from them later. This depends on the rules in the relevant jurisdiction.

Alternative Payment Options

Sofaree may work with providers that offer financing or installment payment options. These services are optional and subject to the third-party provider’s terms.

Sofaree does not endorse or assume responsibility for any third-party financing or alternative payment services. Use of such services is at your own risk.

Fraud Prevention

If Sofaree detects signs of fraud, abuse, or connections to restricted entities or individuals, we may:

  • Request additional verification from you,

  • Cancel any related bookings,

  • Suspend or close associated accounts, and

  • Pursue legal action if necessary.

If your booking is canceled due to suspected fraud, you will be notified. You may contact our support team to appeal or clarify the issue.

Section 5: Canceling or Changing a Booking

If You Cancel or Modify a Booking

Unless the Listing Owner allows changes or cancellations under their Rules and Restrictions, bookings on Sofaree are generally considered final.

If you choose to cancel:

  • Any refund will depend on the cancellation policy provided by the Host or Service Partner.

  • Sofaree’s service fee will only be refunded if the Listing Owner’s policy allows for a full refund.

  • Whether taxes are refunded depends on applicable laws in the relevant jurisdiction.

The cancellation policy for each Listing is made available to you before you confirm a booking. Make sure to review it carefully to understand your options and obligations.

If you need to change or cancel a reservation, use the Sofaree platform to make your request. Please note that approval of changes is at the discretion of the Host or Service Partner and may result in additional fees or taxes.

If We or the Listing Owner Cancel

In rare cases, Sofaree may need to cancel a reservation due to legal obligations or security concerns. If this happens, we’ll make reasonable efforts to help you rebook a similar Listing.

A Host or Service Partner may cancel your reservation if payment is not received in full, or if you violate the Rules and Restrictions attached to the Listing.

Refunds

Refunds will be issued using the same payment method you used during booking. The time it takes to receive your funds will vary depending on your financial institution.

All refunds will be processed in the original payment currency. If your bank applies currency conversion during the refund, the final amount received may differ from what you originally paid. Sofaree does not cover any related bank fees or currency conversion losses.

Section 6: Listing-Specific Terms

Each Listing on Sofaree—whether an accommodation, guided experience, or activity—is subject to specific terms and conditions set by the Host or Service Partner. These may include, but are not limited to:

  • Check-in/check-out times,

  • Guest capacity limits,

  • Age or qualification requirements,

  • Identification verification,

  • House rules or behavior guidelines,

  • Special equipment or clothing requirements.

You are responsible for reviewing these details carefully before confirming your booking. By completing your reservation, you agree to comply with all applicable rules and instructions provided by the Listing Owner.

Failure to follow the Listing’s terms may result in denial of service, additional charges, cancellation of your booking, or removal from the property or activity. In such cases, you are not entitled to a refund.

Special Requirements

Some Listings may require you to meet specific conditions—such as possessing a valid driver’s license, signing a waiver, or attending a safety briefing—before participation. These requirements will be disclosed in the Listing description.

If you do not meet the necessary conditions at the time of service, the Host or Service Partner has the right to deny access without compensation.

Third-Party Services or Suppliers

Certain experiences may be delivered by independent third parties affiliated with the Host or Service Partner. In such cases, you may be required to sign a separate agreement or waiver with that provider.

Sofaree is not responsible for any issues or claims arising from services performed by these third parties, and your participation is at your own risk.

Section 7: Responsibilities of Users

User Conduct

When using Sofaree, you agree to act responsibly, lawfully, and respectfully toward other users, Hosts, Service Partners, and third parties. You must not:

  • Violate local, national, or international laws,

  • Use the platform for illegal or unauthorized purposes,

  • Engage in behavior that may harm, intimidate, or harass others,

  • Misrepresent yourself or your intentions when booking a Listing,

  • Attempt to circumvent platform fees or payment systems.

Any misuse of the platform may result in the suspension or termination of your account, cancellation of bookings, or legal action if warranted.

Responsibility for Accuracy

You are responsible for providing accurate, complete, and up-to-date information when registering, booking, or communicating with Hosts or Service Partners. This includes your name, contact details, payment information, and any other data required to complete a transaction.

If false or misleading information is provided, your reservation may be canceled without refund.

Legal and Regulatory Compliance

You agree to comply with all legal obligations that apply to your booking or participation in an accommodation or experience, including visa, customs, health, and safety requirements. Sofaree is not responsible for your failure to meet these obligations.

Respect for Listing Terms

You must respect the specific terms set by each Listing Owner, including house rules, time restrictions, required documentation, or safety instructions. Violation of these terms can result in denial of service without refund.

You also agree not to damage property, remove items, or engage in disruptive or illegal behavior during your stay or activity. Hosts have the right to report misconduct, and you may be held financially liable for damages or extra cleaning fees.

Insurance

Sofaree recommends that Guests obtain appropriate insurance coverage, including travel, health, accident, and liability insurance, depending on the nature of the Listing. It is your responsibility to verify whether coverage is provided by the Host, required separately, or recommended for the experience or accommodation.

Section 8: Responsibilities of Hosts and Service Partners

Accuracy of Listings

Hosts and Service Partners are responsible for ensuring that all details included in their Listings—such as descriptions, pricing, availability, amenities, rules, and requirements—are accurate and kept up to date.

Misrepresentation of a Listing may result in penalties, removal from the platform, or legal liability. Sofaree reserves the right to suspend or remove any Listing found to contain misleading or false information.

Compliance with Laws

All Hosts and Service Partners must comply with applicable local, national, and international laws, including but not limited to:

  • Tax regulations,

  • Zoning and property use rules,

  • Safety and health codes,

  • Licensing or permit requirements.

It is the sole responsibility of the Listing Owner to ensure that their accommodations or experiences are legally authorized and meet all required standards. Sofaree does not assume liability for a Host’s failure to comply with such obligations.

Service Quality and Delivery

Hosts must fulfill all aspects of their Listings as advertised. This includes:

  • Making accommodations or experiences available as booked,

  • Providing safe and appropriate environments,

  • Respecting check-in/check-out times,

  • Offering support or communication when needed.

Any failure to deliver the Listing as promised may result in cancellation, loss of earnings, or removal from the platform. Repeated violations can lead to permanent suspension.

Responsiveness and Communication

Hosts and Service Partners are expected to respond promptly to Guest inquiries and booking requests. Clear and respectful communication helps build trust and supports positive outcomes for all parties.

Unresponsive or inactive Listing Owners may have their Listings paused or removed until resolved.

Insurance and Risk Mitigation

Hosts are encouraged to maintain appropriate insurance coverage for their accommodations, experiences, or activities. This includes liability insurance, property protection, and any policies required by local law.

While Sofaree may offer optional insurance programs in certain jurisdictions, participation is voluntary unless otherwise stated. Listing Owners are responsible for understanding and mitigating any risks associated with their services.

Section 9: Disclaimers and Limitation of Liability

Platform as a Marketplace

Sofaree is an online marketplace that connects Guests with independent Hosts and Service Partners who offer accommodations, experiences, or related Listings. Sofaree does not own, manage, or operate any Listings directly and is not a party to the agreements made between users and Listing Owners.

While we facilitate these connections, Sofaree does not control the quality, safety, legality, or suitability of any Listing, nor can we guarantee that a Host or Guest will perform as expected. Each user is responsible for verifying the accuracy and appropriateness of their arrangements.

No Endorsement

Sofaree does not endorse any specific Host, Listing, or user. Profiles, reviews, and ratings are provided by users and do not represent Sofaree’s opinions, guarantees, or validations.

We do not verify all user content and cannot be held responsible for false, misleading, or outdated information shared by others on the platform.

Service Availability and Access

Sofaree strives to maintain a reliable platform, but we do not guarantee that the site or app will always be free from errors, interruptions, or delays. Access may occasionally be limited for maintenance, upgrades, or technical issues beyond our control.

We are not liable for any losses, disruptions, or inconveniences caused by system outages, bugs, or platform errors.

Limitation of Liability

To the fullest extent permitted by law, Sofaree shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages,

  • Loss of profits, data, or goodwill,

  • Disputes or misconduct involving Hosts, Guests, or third-party providers,

  • Injuries, damages, or losses incurred during the use of any Listing,

  • Delays, cancellations, or access issues related to Listings.

Your use of the platform is at your own risk. All Listings are provided “as is” without warranties of any kind—express or implied—including warranties of merchantability, fitness for a particular purpose, or non-infringement.

User Responsibility

By using Sofaree, you acknowledge that it is your responsibility to assess risks, research Hosts or Listings, and make informed decisions based on your personal needs and preferences. We encourage communication between Guests and Listing Owners to ensure clarity and safety.

Section 10: Dispute Resolution and Governing Law

Initial Resolution Efforts

If a disagreement arises between you and another user—whether Guest, Host, or Service Partner—you agree to make a good-faith effort to resolve the issue directly through communication on the Sofaree platform. Many concerns can be addressed quickly through mutual understanding and cooperation.

Sofaree encourages the use of its resolution tools, support team, or dispute channels when needed. While we may offer guidance or assistance, we are not obligated to mediate or enforce outcomes unless required by law.

Binding Arbitration

If a dispute cannot be resolved informally, you and Sofaree agree that any legal claim or controversy relating to your use of the platform, your account, or any Listing will be settled through binding arbitration, rather than in court, except where prohibited by applicable law.

This agreement to arbitrate applies to:

  • Contract disputes,

  • Claims related to payments, Listings, or interactions with other users,

  • Allegations involving platform features or services.

You and Sofaree waive the right to a jury trial and agree not to pursue claims through class actions unless such waivers are unenforceable in your jurisdiction.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Seychelles, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in the Republic of Seychelles.

Venue for Disputes

Where arbitration is not allowed or is waived, you agree that any legal proceedings will be brought exclusively in the appropriate courts of the jurisdiction where Sofaree is incorporated, unless local consumer protection laws specify otherwise.

Sofaree reserves the right to seek injunctive or equitable relief in any jurisdiction where harm to the platform, its users, or its intellectual property may occur.
